Terms of Service

These Terms of Service ("Terms") govern your use of the MagentaLine mobile application and the magentaline.app website (together, the "Service"), operated by HiveByte AI, LLC ("we," "our," or "us"). By creating an account or using the Service, you agree to these Terms.

Aviation Safety Disclaimer

MagentaLine is a supplemental situational-awareness tool (Type B EFB) only. It is NOT a certified navigation device and must never be used as your primary or sole means of navigation, weather avoidance, terrain avoidance, or traffic separation.

You are responsible for complying with all applicable regulations, including preflight action requirements (e.g., 14 CFR § 91.103). Always verify aeronautical information against current official publications, obtain a briefing from approved sources, and exercise pilot-in-command judgment. Charts, weather, traffic, terrain, and airspace data presented by the Service may be delayed, incomplete, or inaccurate.

Your Account

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be legally capable of entering into these Terms to use the Service.

Subscriptions and Billing

Access to the Service requires an active paid subscription after any free trial period.
Subscriptions are purchased and managed through your account on our website; they are not sold inside the mobile application.
Subscriptions are billed annually and renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account page; access continues through the end of the paid period.
Displayed prices exclude sales tax. Where required, applicable sales tax is calculated and collected at checkout based on your billing address, and appears on your invoice.
New accounts receive a free trial with no payment method required; a subscription starts only when you check out.
Refunds: if something isn't working for you, contact us within 14 days of a charge and we will work with you, including refunding the charge where appropriate. Cancelling stops the next renewal; it does not retroactively refund the current period.
Prices may change; we will provide notice before a change affects your renewal.
Payments are processed by Stripe; we do not store your card details.

Acceptable Use

You agree not to:

Share one account across multiple pilots or resell access to the Service;
Reverse engineer, scrape, or bulk-extract data from the Service;
Interfere with or disrupt the Service or its infrastructure;
Use the Service in violation of any law or regulation.

Data Sources

The Service aggregates data from third-party and government sources, including the Federal Aviation Administration (FAA), the National Oceanic and Atmospheric Administration (NOAA), and other providers. We do not control and cannot guarantee the accuracy, completeness, or timeliness of third-party data.

Intellectual Property

The Service, including its software, design, and branding, is owned by HiveByte AI, LLC and protected by applicable intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for personal use while your subscription is active.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE CURRENT OR ACCURATE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIVEBYTE AI, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE, INCLUDING DECISIONS MADE IN CONNECTION WITH FLIGHT PLANNING OR OPERATION OF AN AIRCRAFT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Termination

You may stop using the Service and delete your account at any time from your account page. We may suspend or terminate access for violation of these Terms. Sections that by their nature should survive termination (including disclaimers and limitations of liability) do so.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
